On March 25, 2020, Jay Inslee, the governor of Washington State signed HB 2565-2019 – a bill Concerning the Labeling of Disposable Wipes Products. The signed bill requires non-flushable disposable wipes that are pre-moistened, constructed from nonwoven sheets, and designed and marketed for diapering, personal hygiene, or household hard surface cleaning purposes to have the Association of Nonwoven Fabrics Industry (INDA) “Do not flush” symbol, or a gender equivalent, on the packaging. The “Do not flush” symbol shall meet the following requirements:
• The symbol shall be on the principal display panel, if the packaging is intended to dispense individual wipes, the symbol shall be visible each time a wipe is dispensed
• The symbol shall cover at least 2% of the surface area of the panel in which it is presented
• The symbol shall not be obscured or covered by packaging seams, folds, or other design elements
• It shall be in high contrast to the information around it
The law excludes wipes designed or marketed for cleaning or medicating the anorectal or vaginal areas that are labeled as “flushable,” “sewer safe,” “septic safe,” or otherwise indicate that it can be disposed in a toilet, including, but not limited to, pre-moistened toilet tissue.
The labeling requirements take effect on July 1, 2022, but products that fall under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) have until July 1, 2023 to comply.
