Toxics in Packaging Clearinghouse Publishes Update to Model Legislation

In February of 2021, the Toxics in Packaging Clearinghouse (TPCH) published an update to their Model in Toxics Packaging Legislation. The 2021 version of the Legislation includes the addition of phthalates, perfluoroalkyl and polyfluoroalkyl substances (PFAS) as regulated chemicals within packaging. 

The phthalate prohibition states that a manufacturer, supplier or distributor may not offer for sale or for promotional purposes a package or packaging component to which phthalates have been intentionally introduced during manufacturing or distribution in any amount. The sum of the concentration levels of phthalates incidentally present in any package or packaging component shall not exceed 100 parts per million by weight (0.01%). 

The PFAS prohibition states that a manufacturer, supplier or distributor may not offer for sale or for promotional purposes a package or packaging component to which PFAS has been intentionally introduced during manufacturing or distribution in any amount. There shall be no detectable PFAS in any package or packaging component. 

The current heavy metal in packaging legislation, with respect to lead, cadmium, chromium and hexavalent chromium, remains unchanged. 

Currently, there are nineteen states with toxics in packaging laws so it will be up to each state to review the updates in the Model Legislation and make the determinations if their state law needs to be updated based on the changes made to the 2021 Model Legislation updates.
