On August 3rd 2020, the European Union proposed a new restriction for certain perfluorinated substances.
The restriction will cover Perfluorocarboxylic acids containing 9 to 14 carbon atoms in the chain as well as related substances. Limits will be 25 ppb and 260 ppb for related substances. Regulation will come into force 18 months after publication.
Background
On August 3rd 2020, the European Union notified the World Trade Organisation (WTO) about their plan to restrict Perfluorocarboxylic acids containing 9 to 14 carbon atoms in the chain (C9-C14 PFCAs) under REACH Annex XVII Entry 68. This restriction aims to prevent a switch by industry using PFOA-based substances ("C8 chemistry") to longer chain PFCs.
For the following substances, a limit of 25 ppb is proposed:
• Linear and branched perfluorocarboxylic acids of the formula CnF2n+1-C(=O)OH where n=8, 9, 10, 11, 12, or 13 (C9-C14 PFCAs), including their salts, and any combinations thereof;
For the following substances, a limit of 260 ppb is proposed:
• Any C9-C14 PFCA-related substance having a perfluoro group with the formula CnF2n+1- directly attached to another carbon atom, where n=8, 9, 10, 11, 12, or 13, including any combinations thereof;
• Any C9-C14 PFCA-related substance having a perfluoro group with the formula CnF2n+1- directly attached to another carbon atom, where n=8, 9, 10, 11, 12, or 13, including any combinations thereof;

PFNA - Perfluorononan-1-oic acid (C9-PFCA, CAS 375-95-1)
PFDA - Nonadecafluorodecanoic acid (C10-PFCA, CAS 335-76-2)
PFUnDA - Henicosafluoroundecanoic acid (C11-PFCA, CAS 2058-94-8)
PFDoDA - Tricosafluorododecanoic acid (C12-PFCA, CAS 307-55-1)
PFTrDA - Pentacosafluorotridecanoic acid (C13-PFCA, CAS 72629-94-8)
PFTDA - Heptacosafluorotetradecanoic acid (C14-PFCA, CAS 376-06-7)
which are already listed as substance of very high concern (SVHC).
Publication is expected in the first quarter of 2021. It will come in force 18 months after publication.
