On June 12, 2019 the New York Department of Environmental Conservation (DEC) issued an Environmental Notice that they will not enforce the original July 1, 2019 compliance date for the Household Cleansing Product Disclosure Program. They will now take enforcement action starting on January 2, 2020. Earlier this year, the NY DEC indicated that they would not enforce the July 1, 2019 compliance date until October 2, 2019.
Per the new enforcement policy, by January 2, 2020 manufacturers shall submit a completed Certification Form, as found in the guidance, to the New York DEC. Manufacturers also need to begin disclosing ingredient information on the product website, including all intentionally added ingredients and nonfunctional ingredients above trace. As a reminder, for the purposes of the policy, “manufacturer” includes any person that either produces, prepares, formulates, or compounds a covered product and whose name appears on the label, or which distributes the covered product, and is identified on the product label per the Fair Packaging and Labeling Act (FPLA) requirements.
