Judge Invalidates New York State Household Cleansing Product Information Disclosure Program

A New York State Supreme Court Judge invalidated the New York Household Cleansing Product Information Disclosure Program, which would have required manufacturers of household cleansing products sold in New York State to disclose the ingredients, fragrance allergens, and other nonfunctional constituents the product might contain on their website. Shortly after the New York Department of Environmental Conservation (DEC) issued the Disclosure Program guidance documents, it was challenged by the American Cleaning Institute (ACI) and the Household & Commercial Products Association (HCPA). They argued that the New York DEC did not follow proper state administrative procedures. On August 27, 2019, the Judge ruled in favor of the ACI and HCPA, invalidating the Disclosure Program, stating that the New York DEC did not go through the proper regulatory procedures before issuing the guidance, which was effectively a rule. 

Reminder

Although the New York Household Cleansing Product Information Disclosure Program is no longer in effect, the California Cleaning Product Right to Know Act ingredient disclosure is still taking effect – starting January 1, 2020.
