Indonesia MENKOMINFO issued new regulation PM No. 1/2019 on use of Radio Spectrum Frequency Based on Class License

On May 8, 2019 Indonesia Ministry of Communication and Information Technology has issued a new Regulation Number 1 of 2019 dated April 24, 2019. This is a regulation on the use of Radio Spectrum Frequency Based on Class License. 

Below is the summary of this regulation. 

TECHNICAL PROVISIONS OF CLASS LICENSES 
1. Class permission is given for the use of Telecommunication Tools and / or Devices: 
a. WLAN 
b. SRD 
c. DSRD 
d. LAA 
e. Non-Cellular LPWA; and / or 
f. operating on radio frequency bands used based on similar Class Permits according to the level of technology and characteristics. 

2. SRD Telecommunication Tools and / or Devices include: 
a. Bluetooth 
b. Telecommunication devices and / or devices with transmittance below 10 mW 
c. Radio Frequency Identification (RFID) 
d. Near Field Communication (NFC); and 
e. Wireless Personal Area Network (WPAN)/IEEE 802.15.4 

3. Radio Frequency Bands are used provided that: 
a. shared use of time, territory and / or technology in harmony between users; 
b. prohibited from causing harmful radio frequency interference; 
c. does not get interference protection from other users; and 
d. must follow the stipulated technical provisions. 

4. Regarding WLAN 
- WLAN Telecommunication Tools and / or Devices as referred to in Article 2 paragraph (1) letter a can operate in: 
a. single band / single mode on Radio Frequency Bands: 
2 400 - 2 483.5; 
5 150 – 5 250 MHz; 
5 250 – 5 350 MHz; or  
5 725 – 5 825 MHz; 
or 
b. multi band / multi mode in 2 (two) or more Radio Frequency Bands as referred above. 

- The use of a base station / access point for outdoor WLAN can only be operated on a radio frequency band: 
2 400 - 2 483.5; and/or  
5 725 – 5 825 MHz; 

Base Station / Access Point for indoor use WLAN can operate on Radio Frequency Bands: 
2 400 - 2 483.5; 
5 150 – 5 250 MHz; 
5 250 – 5 350 MHz; or  
5 725 – 5 825 MHz; 

- The Base Station / Access Point used for indoor use must use an antenna that cannot be assembled (fixed and built in). 
- may not be equipped with a Country Region selection feature; and 
- must be equipped with a Radio Frequency Band lock (permanent and cannot be removed.), so that it can only operate on factory lock Radio Frequency Bands. 

5. Regarding LAA 
- LAA Telecommunication Tools and / or Devices can only be operated by cellular mobile network operators. 

- The Operator in operating the LAA Telecommunication Tools and / or Devices must activate the features: 
a. listen before talk; 
b. dynamic frequency selection; 
c. transmit power control; and 
d. frequency channel selection. 

- can operate on Radio Frequency Bands: 
5 150 – 5 250 MHz; 
5 250 – 5 350 MHz; or  
5 725 – 5 825 MHz; 

- The use of LAA for outdoor, can only be operated on the radio frequency band 5 725 - 5 825 MHz. 

- The use of LAA for indoor, can only be operated on the radio frequency bands: 
5 150 – 5 250 MHz; 
5 250 – 5 350 MHz; and/or  
5 725 – 5 825 MHz; 

6. Regarding Non-Cellular LPWA
- Non-Cellular LPWA Telecommunication Tools and / or Devices consists of: Wideband and Narrowband 
- Non-Cellular LPWA can only be operated by data communication system operators. 

CLOSING 
- When this Ministerial Regulation comes into force, the following existing requlation will be revoked and declared invalid. 
1. PERMENHUB No. KM. 2 Tahun 2005 concerning the Use of Frequency Bands 2400-2483.5 MHz; 
2. PERMENKOMINFO No. 27/PER/M.KOMINFO/06/2009 concerning Determination of Radio Frequency Bands for the Need for Wireless Broadband Services at 5.8 GHz Radio Frequency Bands; 
3. PERMENKOMINFO No. 28 Tahun 2015 concerning Technical Requirements of Telecommunication Tools and Equipment Operating on 2.4 GHz Radio Frequency Bands and / or 5.8 GHz Radio Frequency Bands (State Gazette of the Republic of Indonesia of 2015 Number 1092) 
4. PERMENKOMINFO No. 35 Tahun 2015 concerning Technical Requirements of Short Range Devices (State Gazette of the Republic of Indonesia of 2015 Number 2042); 
5. PERDIRJENPOSTEL No. 09/DIRJEN/2004 concerning Bluetooth Technical Requirements; and 
6. PERDIRJENPOSTEL No. 221/DIRJEN/2007 concerning Technical Requirements of Tools and Equipment of Radio Frequency Identification (RFID) Reader at Frequency 923 - 925 MHz, 

- This Ministerial Regulation comes into force when promulgated on April 24, 2019.
