Governor Cuomo Signs Bill Banning Crib Bumper Sales in New York State

On Tuesday, August 13, 2019, New York State Governor Andrew Cuomo signed NYS Senate Bill 3788 into law prohibiting the sale of crib bumper pads and restricting the use of crib bumper pads in certain settings. This law will become effective on October 12, 2019. 

SB 3788 was introduced in the NYS Senate on February 14, 2019. The bill defines crib bumper pads as a pad or pads of a non-mesh material resting directly above the mattress in a crib, running the surface area of the crib or along the length of any of the interior sides of the crib. "Crib bumper pad" does not include mesh liners.

SB 3788 state that no manufacturer, importer, distributor, wholesaler, retailer or secondhand dealer shall sell, lease, offer for sale, or offer for lease in NYS any crib bumper pad as an accessory to a crib or as a separate item.

SB 3788 also states that no child care facility or place of public accommodation shall use or have on the premises any crib bumper pads unless a medical professional has determined that use of crib bumper pads is medically necessary for a particular child using a crib in such child care facility or place of public accommodation.

New York State is the third US state to ban crib bumper pads along with Maryland and Ohio. Crib bumpers are also banned in the city of Chicago and Watchung borough in New Jersey. There are also proposed bans in Vermont, Illinois, and Missouri.
