CPSC Publishes Direct Final Rule for Gates and Enclosures

On Tuesday September 28, 2021, the U.S. Consumer Product Safety Commission (CPSC) staff published within the Federal Register a Direct Final Rule for 16 CFR Part 1239, Safety Standard for Gates and Enclosures. 16 CFR Part 1239 will now reference ASTM F1004-21, Standard Consumer Safety Specification for Expansion Gates and Expandable Enclosures as mandatory with no modifications. 

The previous version of the 16 CFR 1239 referenced the ASTM F1004-19 version with several modifications. The ASTM F1004-21 version was revised to harmonize itself with the original Final Rule published in July 2020. 

This Direct Final Rule will become effective January 22, 2022 unless the CPSC receives any significant or adverse comments within 30 days from the Federal Register publication date.
