As previously announced, the Corded Window Coverings Regulation for Canada was revised in May of 2019 and specified new, more stringent requirements for the window covering industry. In particular, the updates greatly restrict the length of reachable cords and the size of loops that can be created on window coverings, in an effort to reduce the possibility of child strangulation. These new requirements apply to all indoor window covering products (both custom-made and stock products) that contain at least one cord. The updated regulation specified that it will come into force on May 1, 2021.
Recently, Health Canada issued a letter to the window covering industry stakeholders announcing that due to the COVID-19 pandemic and impacts on Canadian businesses, Health Canada plans to alter their compliance and enforcement activities regarding this regulation. The letter noted the following in regards to the Corded Window Coverings Regulations (CWCR):
• From May 1, 2021, to April 30, 2022, Health Canada intends to prioritize promoting awareness of and compliance with the CWCR. We will also be monitoring progress towards compliance; and
• Beginning on May 1, 2022, Health Canada intends to increase its compliance monitoring activities and take appropriate enforcement action, where necessary, to address identified instances of non-compliance to the CWCR.
The letter also noted that although this revised action plan is being specified, the coming-into-force date for the regulation is not being delayed and Health Canada “expects industry to make best efforts to comply with these upcoming Regulations despite the circumstances.” And further it states that “the Department will enforce the CWCR anytime on or after May 1, 2021, if warranted, based on incidents, complaints, or the level of risk. However, Health Canada’s proactive activities will be focused on compliance promotion looking toward May 1, 2022.”
