California Proposition 65 Settlements

The following is a summary of California Proposition 65 settlements recently finalized that involve food products (vegetables chips) and other consumer products (bota bags, bug nets, crochet hook sets, jump ropes, eyelash curlers and tweezers, makeup sponges, toddler leashes, floor scrapers with grips, PVC air hoses, vinyl aprons, vinyl organizers, footwear, apparel and belts, vinyl fabric, mattress protectors/covers). 

Bota bags
• Requirement
     o No more than 0.1% (1000 ppm) DINP
     o Or utilize a warning statement 

Bug nets
• Requirement
     o No more than 0.1% (1000 ppm) for each phthalate (DEHP, DBP, BBP, DIDP, and DnHP)
     o Or utilize a warning statement 

Pouches for dry erase markers
• Requirement
     o No more than 0.1% (1000 ppm) for each phthalate (DEHP, DBP, BBP, DIDP, and DnHP)
     o Or utilize a warning statement 

Crochet hook sets
• Requirement
     o No more than 0.1% (1000 ppm) DEHP
     o Or utilize a warning statement 

Jump ropes
• Requirement
     o No more than 0.1% (1000 ppm) DBP
     o Or utilize a warning statement 

Eyelash curlers and tweezers
• Requirement
     o Eyelash Curlers: No more than 0.1% (1000 ppm) for each phthalate (DEHP, DBP, BBP, DINP, DIDP, and DnHP)
     o Tweezers: No more than 0.1% (1000 ppm) of each DEHP, BBP and DBP
     o Warning label cannot be used as an alternative to meet the requirement 

Eyelash curler with grips
• Requirement
     o a. Less than 0.009% (90 ppm) total lead, and 
        b. no more than 1 mg result in Ghost WipeTM test
     o Warning label cannot be used as an alternative to meet the requirement 

Makeup sponges
• Requirement
     o No more than 0.1% (1000 ppm) for each phthalate (DEHP, BBP, DBP, DINP, DIDP and DnHP)
     o Warning label cannot be used as an alternative to meet the requirement 

Toddler leashes
• Requirement
     o No more than 0.1% (1000 ppm) for each phthalate (DEHP, BBP, DBP, DINP, DIDP and DnHP)
     o Or utilize a warning statement 

Floor scraper with grips
• Requirement
     o No more than 0.1% (1000 ppm) for each phthalate (DEHP, BBP, DBP, DINP, DIDP and DnHP)
     o Or utilize a warning statement 

PVC air hoses
• Requirement
     o No more than 0.1% (1000 ppm) for each phthalate (DEHP, BBP, DBP, DINP, DIDP and DnHP)
     o Or utilize a warning statement 

Vinyl aprons
• Requirement
     o No more than 0.1% (1000 ppm) for each phthalate (DEHP, BBP, DBP, DINP, DIDP andDnHP)
     o Or utilize a warning statement 

Vinyl organizers
• Requirement
     o No more than 0.1% (1000 ppm) for each phthalate (DEHP, BBP, DBP, DINP, DIDP and DnHP)
     o Or utilize a warning statement 

Footwear
• Requirement
     o No more than 0.1% (1000 ppm) for each phthalate (DEHP, BBP, DBP, DINP, DIDP and DnHP)
     o Warning label cannot be used as an alternative to meet the requirement 

Apparel and belts
• Requirement
     o No more than 0.1% (1000 ppm) for each phthalate (DEHP, BBP and DBP)
     o Warning label cannot be used as an alternative to meet the requirement 

Bulk vinyl fabric
• Requirement
     o No more than 0.1% (1000 ppm) for each phthalate (DEHP, BBP, DBP, DINP, DIDP and DnHP)
     o Label:
         - Utilize a warning statement (for DINP, DIDP and DnHP)
         - Warning label cannot be used as an alternative to meet the requirement  (for DEHP, BBP, DBP). 

Mattress protectors/covers
• Requirement
     o No more than 0.1% (1000 ppm) for each phthalate (DEHP and DINP)
     o Or utilize a warning statement 

Vegetable chips
• Requirement
     o No more than 17 ppb total lead
     o Or utilize a warning statement
