The following summarizes a number of finalized California Proposition 65 settlements that involve certain food products (dark chocolate almonds or walnuts, cake, bread, coffee products, molasses, beet chips, cacao nibs, wine vinegar, seaweed, dried anchovies, broken rice, crackers, spices) and other consumer products (PVC handle of lunch bag, bookmark including packaging, cover for bookmark magnifier, feeding bottle nipples).
Dark Chocolate Almonds or Walnuts
• Requirement
o No more than 225 ppb acrylamide
o Labeling is not allowed
Cake
• Requirement
o Shall not contain acrylamide
o Or utilize a waring statement
Bread
• Requirement
o No more than 0.2 ppm acrylamide
o Labeling is not allowed
Coffee Products
• Requirement
o Shall not contain acrylamide
o Or utilize a waring statement
Molasses
• Requirement
o No more than 325 ppb acrylamide
o No more than 35 ppb total lead
o Products that exceed the limit shall utilize a warning statement
Beet Chips
• Requirement
o No more than 0.5 micrograms of lead and 4.1 micrograms of cadmium per day in daily exposure level
o Labeling is not allowed
Cacao Nibs
• Requirement
o No more than 4.1 micrograms of cadmium per serving
o Products that exceed the limit shall utilize a warning statement
Wine Vinegar
• Requirement
o No more than 34 ppb total lead
o Products that exceed the limit shall utilize a warning statement
Seaweed
• Requirement
o No more than 75 ppb total lead, 95 ppb total cadmium and 15 ppb total arsenic
o Products that exceed the limit shall utilize a warning statement
Dried Seaweed
• Requirement
o No more than 0.5 micrograms of lead and 4.1 micrograms of cadmium per day in daily exposure level
o Products that exceed the limit shall utilize a warning statement
Dried Anchovies
• Requirement
o No more than 10 ppb total lead, 85 ppb total cadmium and 20 ppb total arsenic
o Products that exceed the limit shall utilize a warning statement
Broken Rice
• Requirement
o No more than 56 ppb total lead
o Products that exceed the limit shall utilize a warning statement
Crackers
• Requirement
o No more than 280 ppb acrylamide for honey graham crackers and biscuits
o No more than 75 ppb acrylamide for animal crackers
o Labeling is not allowed
Spices
• Requirement
o No more than 275 ppb total lead for curry powder
o No more than 720 ppb total lead for ground ginger
o No more than 375 ppb total lead for ground sage
o Products that exceed the limit shall utilize a warning statement
PVC Handle of Lunch Bag
• Requirement
o No more than 1000 ppm of DINP
o Products that exceed the limit shall utilize a warning statement
Bookmark including Packaging
• Requirement
o No more than 1000 ppm each of DEHP, DBP, DINP, DIDP, DnHP and BBP
o Products that exceed the limit shall utilize a warning statement
o Labeling is not allowed if “Phthalate Free” claim is on the product
Cover for Bookmark Magnifier
• Requirement
o No more than 1000 ppm of DINP
o Products that exceed the limit shall utilize a warning statement
Feeding Bottle Nipples
• Requirement
o No more than 1000 ppm of DEHP
o Labeling is not allowed
