The California Department of Toxic Substances Control (DTSC) recently proposed two priority products under the Safer Consumer Products (SCP) regulations. A priority product is a consumer product identified by DTSC that contains one or more chemicals, known as candidate chemicals that have a hazardous trait that can harm people or the environment.
On September 24, 2021 DTSC initiated rulemaking to list Treatments Containing Perfluoroalkyl or Polyfluoroalkyl Substances (PFASs) for Use on Converted Textiles or Leathers on products such as carpets, upholstery, clothing and shoes as a priority product. DTSC has determined that there is potential for exposure to PFASs from these products and exposure may contribute to or cause significant or widespread adverse impacts. Products include cleaners, protectants, spot removers, and water proofer or water repellants. It does not include products marketed or sold exclusively for use during the manufacturing of carpets, rugs, clothing, shoes, furniture, or other converted textiles and leathers. Comments will be accepted until November 6, 2021.

On October 1, 2021, DTSCC initiated rulemaking to list Nail Products Containing Toluene as a Priority Product. Nail products containing toluene include nail coatings, nail hardeners, and nail polish thinners. Nail coatings are defined as any clear or color paint, polish, lacquer, enamel or gel product, including solvent-based nail coatings marketed or sold for application to fingernails or toenails. Toluene is a liquid at room temperature and volatilizes into the air. The primary exposure route for toluene in these nail products is vapor inhalation. Comments will be accepted until November 18, 2021.
