California Passes Menstrual Products Right to Know Act

Packages containing menstrual products manufactured on or after January 1, 2023 that are sold in California shall clearly and conspicuously list all ingredients in the menstrual product. The ingredients shall be listed in order of predominance by weight, except for those that are less than 1% in weight, which may be listed in any order at the end. Ingredients shall be listed using International Nomenclature of Cosmetic Ingredients (INCI), the household Commercial Product Association’s Consumer product Ingredient Dictionary (HCPA Dictionary), or by common chemical name. However, ingredients that are confidential business information may be disclosed using a common name. 

In addition to the product disclosure requirements, on January 1, 2023, the manufacturer’s websites shall also include the menstrual product ingredient information that is required to be on the packaging. 

Reminder: New York State has already passed a menstrual product ingredient disclosure bill that takes effect in April, 2021. However, the New York law does not specify the nomenclature that must be used for the ingredients and does not include a website disclosure requirement.
